Can anyone file for chapter 13?Actually anybody can file a chapter 13 doesnt matter about debt. Court has to decide if its valid. It will stop your foreclouser. You will have a creditors meeting if the court deems you dont have a legitimate chapter 13 filing it will kick it out. Then they have to start foreclouser again. Which takes another month or so. Just file it the day before.
Now if you dont show up to your creditors meeting it will be dismissed. Once again meaning they have to start foreclouser again. But a month or two later you can file another chapter 13. After 3-4 times the court will get pissed and say you can do it anymore more.
If you keep doing it, you can stay in the house for maybe 8-12 months but your lender will hate you. Just file and dont show up. File again and dont show up. Ive seen it happen so many times.
Im not saying its right Im just answering your question. It will totally destory your credit, but im guessing thats not your issue right now.

But from what you say, you don't have any debts except for a mortgage which they are foreclosing in. A chapter 13 does not write off your mortgage, it just buys you some time to help pay it off. You still have to keep making the payments on the home though.
