I had a brand new 2005 malibu, i seperated from my husband 3 months later he took the car from me(i couldn't pay by myself with the kids ) gave it to his girlfriends daughter she paid diligently for three months missed one they took the car"repoed". this is all 2005. Now its 2007 nearly 2 years later, i had tried to get a car and the credit report said repo had been satisfied. Now today i get a call off the wall from a collections agency from out of state telling me i owe 17.000.00 dollars for this car that the original bank loan was 12,000.00 at 16% interest. So who repoed the car and got the money? Why am i having to pay back the entire bill and why am i barely being contacted they have had my info for two years the loan company was capital one. Can someone explain this to me? This is so far out of my realm right now i think i can do a mental shut down and be comforatbly numb! Any ideas haw to do that too!! Thanks in advance for any and all advice anyone has i wait to hear
Car Reposession?This could be a scam. You need to find your old paperwork, and contact the bank/car dealership, and trace it back thru THEM to see if it's satisfied or not, and get a certified letter from them that it is. Or, get a lawyer. Usually once a bank or dealership repo's the car, then they resell it. It "may" have lost some value , but it won't be for the full amount! You're being scammed, I'd almost bet. DON'T send them ANY money until you either 1) get a lawyer , or 2) check with the bank who did the loan, and/or the car dealership. So, quit bawlin' and start callin'....try the bank who loaned you money, then the car dealership. Since this notice is from out of state, I'd bet it's fraudulent. You MIGHT want to consider calling your state or county fraud hotline, or police, to see if this can be traced for legitimacy. There are hotlines out there for stuff like this, so don't SIGN any CHECKS until you find out for SURE.

Car Reposession?like he said,no checks...even if it's not fraudulant,once a collection agent gets your acct#,they can wipe you out if they have gotten a judgement against you...get a lawyer...sue your ex,an oral agreement to pay for the car may be enforceable...was the debt mentioned in the divorce agreement?....
