I sued a car wash business because they damaged my car. They never showed so I received a default judgment. This was about 2 years ago. I was told that I needed to hire a private investigator to find out what bank they used and to obain their bank account number, or find out their licence plate numbers, etc. They are still in business, but I never pursued getting my money because I figured it would cost me more than it was worth. The judgment was for about $600. Is there anything I can do now? This happened to my dad a while ago and he never pursued it either. Years later when the person he was dealing with tried to apply for a loan and buy a home, my dad was sent a check in the mail. Is it ever too late?
How can I collect my money from a default judgment in small claims court?Getting a judgement in Small Claims court is the easy part. Most cases end up in Civil Court to actually get the money owed.
How can I collect my money from a default judgment in small claims court?with a judgment you can place a lien on the business, so if the owners try to sell, you will get your compensation. if you do not record the lien, you will get nothing. your dad must have placed a lien on the guy he sued's property. you have to do the same.
How can I collect my money from a default judgment in small claims court? You could either levy their bank accounts or do a till tap...those cost $$$ and you probably wouldn't get much back. I think the till tap is the most expensive so I wouldn't go that route...you could try to levy upon an account but you need to find the account first. Good luck.
