Why not have your buyer write a letter to the Attorney Generals office filing a complaint. That should get someones attention. Go the small claims route - there is not enough money in it for a full blown law suit

Add up your costs..see where that puts each of you. Look at both of these figures... set a cost difference that you think is fair. sit down and discuss the figures...almost anyone will agree to split the difference. This works in most money disagreements. Neither one of you want this to go on any longer than yesterday! Work it out to something that you can both live with. I'm usually not impressed when people threaten me with lawsuits either. You're doing this wrong. It's kinda like a boxing match. The ones who bluster and posture and dance around telling you what they're gonna do are usually the ones who are no good at it.
I tend to be the type who warns you once, and makes dang certain I can back it up. If you threatened him and he didn't budge - file the lawsuit. Should have checked with those attornies BEFORE you threatened him with a lawsuit that no attornies want to file.
If I were you, I wouldn't care what other escrow company's policies are, just the one holding the EMD for my client. If they're not releasing funds held in escrow until both parties agree, that's the end of it until you get mr seller to agree or the 30 days past contract termination date as stipulated in the agreement have elapsed.
Tell the buyer to cool his heels. He should have gotten a preapproval done before you showed him the house anyway. If you had done your job right in the first place, you wouldn't be in this mess.
