could my husband have gotten a loan on a prime equity line with out my signature ??????? we bought a house 6 years ago and one the deed it states his first and last name and the words...(as a married man) ......my name isn't on there,,,,but on the mortgage it is...
could he have gotten a new loan added on with out my signature or he did it unlawfully???? we're not doing too good and we want to sell the house but the loan that he took out is being used by him only he's using it for whatever he wants!!! and i heard if we sell the loan will be paid of first and then we split the rest thats left...but how is that fair when i have no access to the loan and I'm not using any money from it??? could i do anything??? basically i get robbed..

PRIME EQUITY LINE loan question....?THIS IS A VERY DIFFICULT QUESTION TO ANSWER IF HE HAD THE HOUSE BEFORE YOU BOTH GOT MARRIED IT'S HIS HOUSE IF THE HOUSE IS SOLD NO SPLIT NO YOU CAN'T DO ANYTHING WHAT EVER YOU HAD BEFORE YOU GET MARRIED IS YOURS AND WHATEVER HE HAS BEFORE HE GETS MARRIED IS HIS WHEN YOU GET MARRIED WHAT EVER YOU BOTH BUY TOGETHER IS OURS I HOPE THIS HELPS ...........................................
PRIME EQUITY LINE loan question....?it may depend on what state you live in ie community property states, but if your name is not on the title of the house you are probably just screwed, if it is in his name alone, he can (and apparently will) do as he pleases. what happens if he dies suddenly? it leaves you with out a pot to piss in or a window to throw it out of. I would go to the finance company where he took out the loan and see if he forged your name or if it in his name alone. If he forged your name, you do have legal standing, but with a husband who would do something like this you may need to re-evaluate your relationship with him, before you end up like my aunt. her husband took out several loans with the house as collateral (in CA it is legal), then he died leaving her $450,000.00 in debt in addition to the origional loan on the house. she lost everything
