File a complaint just as you would with any other common criminal who stole from you.
Take it to the bank and to the check cashing place and show them that you were a victim of a crime.
Tell them that you look forward to going to court since you wonder why they would allow him to steal from YOU using them (meaning that they could not have checked his ID etc)
Paying this would not even enter into my mind.
Talk to the bank and let them know what is going on.
Show the manager your police report and see if they would be willing to waive the overdraft fees.
Worry not about finding him...a bench warrant will make him very available when he fails to appear for the charges.
Be sure to explain to the police that you were in the hospital and show them proof so that they can include that proof in your police report.
