Hey everyone,
Just had a quick question.
My fiance is in heavy debt, and has been dealing with Collectcorp for a couple of months now. She is also in University and has already started her semester in September.
Her OSAP just cleared, but at the same time, Collectcorp put a hold on her debit account. The stupid thing about that was, she couldn't even pay her bank because of the hold...which makes no sense. Anyway, long story-short... Collectcorp took ALL of her government loaned funds. She now cannot buy her text books, art supplies (she's an art student) nor can she even buy her bus tickets to commute TO school.
Can they do this? Can they take government funded loans? And if not, does anyone know the best way of fighting this, because according to Collectcorp there is nothing they can do, which i hope through the law, we can prove this wrong.
Any input is greatly appreciated, thanks!
Can Collection Agencies take OSAP? Please input!?This might need a little clarification, but here is what I get from your question.
I am going to guess that your fiancee has a judgment against her, and that the creditor levied her bank account.
Certain types of income in a levy action are exempt. Social security is one of them, but I am not really sure about the monies from a government source for education. I would suggest that she file a claim of exemption, immediately, and either contact the government lender to find out about the exemption or talk to a local legal advocate. My guess is that if she doesn't take the steps needed to get the levy returned, the creditor is not going to help her to do so.
