I have a friend who posed the following dilema to me this morning.
His car payment was due 3 days ago. Because they were unable to reach him, the creditor called his parents and his brother. He knows that he did not list his brother as a reference/contact etc on his loan application but acknowledges that he probably did list his parents number.
With that in mind, is it legal for the creditor to call family members who were NOT listed as a reference? It seems to me that 3 days past due is a bit quick to call anyone. Please give me your thoughts???
Is it legal to call a debtor's family for collection?They can call neighbors, or anyone else to leave a message for him, but they cannot disclose they are calling about a past due bill. It doesn't matter who is listed a references. And yes, 3 days is awfully fast to be calling.
Is it legal to call a debtor's family for collection?I don't think there is anything restricting debt collectors from calling people who were not listed as a reference.
However, the debt collectors are not allowed to do anything but ask these people about how to contact the person they are trying to find. They are not allowed to say that they are debt collectors or give information about the debt. Of course, good luck in trying to enforce these rules.
