A couple of years ago, my exgirlfriend bought a car. We were serious, and I was stupid, so I took the loan out in my name and put the car in hers. We broke up (of course) and she stopped making payments on the car. I bought out the loan so that her credit problems (numerous as they were) didn't become my credit problems. I had her sign a promissory note. It wasnt notarized, but it's her signature. Over the past 13 months, she's made 3 payments, and now she doesn't even return my calls. She owes me about $19,000, which on a personal note, came from an inheritance, so I can't even talk to her and see straight at the same time.

I want to enforce the default clause on her contract. She never filed the new lien paperwork, but I have the promissory note and copies of the voided checks. What do I do now? Do I call a lawyer? A debt collector?

A Promissory Note should have included the "Security" for the Note, such as the description of the vehicle. Then to secure it, you would have added a lien to the vehicle title. You didn't mention that you did that. I would go to small claims court and get a judgment, since that is a lot of money that is owed.
