FT pty ltd is trustee of T family trust for 4 children H,E,S,E.Asset of trust was hotelbusiness run by trustee under express power, trustee authorised to invest trust funds.H & E are beneficiaries who held their beneficial interest upon trust for other benefeciaries under sub-trusts.H held his interest upon trust for enstranged wife, W, under a deed of trust which provided that he is not entitled to personal right of indemnity against W. E had her interest for her 3 children F,G &Z. E assigned his interst to another party GM.FT entered into contract with F ltd in Aug 2005 for purchase of $100000 machine.Machine delievered,payment deferred March 2007.Contract by ft Pty ltd under 'as trustee of T family'.Trustee gave unsecured loan of 250000$ to D Pty Ltd run by S of T Family, but it went Bankrupt.No payment to F Ltd.Net assets of FT PTY ltd $10.Net asset of T family trust taken into account value of machine but ignoring any liability with respect to are valued at $20000.
