I have had an Interim Charging Order put on my house.
The house is in joint names (with my wife)
The debt is only in my name (unsecured loan with RBSC)
I am due to go to county court on Jan 3rd
I phoned the National Debtline and they told me that if had a full Charging order on my house i would not be able sell it because a caution would be put on the house because the debt is not in my wifes name so they cant take all the money only half ?
I would have thought that i could still sell it and give them my half of the equity ?
Also a friend of mine said when i go to court to offer some kind of payment scheme that the Interim order will still stand !
I thought that the judge either lifts the order or puts on a perminent charge ?
I owe on several cards and loans (total about 70,000) and have made arrangments with them (Its just RSBC that are being rubbish)
We have about 20,000 in equity in the house ! If i cant sell it my wife wont get her half of the money !!!!!
Charging order UK Law ? Help?Your issue sounds serious but why don't you call the local law farm who deals with these in stead of posting in here?
