I am behind in a loan from Bank of America. It's an unsecured loan, in which my grandmother is a co-signer. Basically, the collection agency told me that I do not fall under the SCRA because I have a co-signer, and they might not be able to sue me, but they will be able to sue my grandmother. Is this possible? Isn't she also protected since I'm the main signer? Please, I need help, if I don't find answers, I will be broke with no money for the next two months, and I'm in the Air Force!
Servicemember civil relief act question? ADVICE NEEDED!?The collection agent is a lying piece of you know what. That is, of course, part of the job description, so no surprise there.
The fact that you have a co-signor does NOT prevent you (and your grandmother) from falling under the protection of the SCRA.
The link below is to the full terms of the Act. Read it through before calling the collection agency back. If they still give you any guff, go to JAG on your base - they'll know how to handle them.

Servicemember civil relief act question? ADVICE NEEDED!?Not true. Section 103 of the act extends the basic protections to guarantors, suretys, and others who may be secondarily liable.
Go to your base legal office for more information. They deal with SCRA issues all the time.
